A Wake County superior court judge has dismissed a lawsuit from 31 former NC State male athletes alleging sexual abuse and misconduct by the school's former director of sports medicine, Robert M. Murphy Jr.

Wake County Superior Court Judge Bryan Collins dismissed the claims on procedural grounds, including an expired statute of limitations. The suit was filed about 17 days after the legal deadline, and 10 plaintiffs also face a 10-year “statute of repose” barring claims for conduct more than a decade old.

The ruling does not address the merits of the allegations. “This dismissal has nothing at all to do with Mr. Murphy's sexual abuse of these 31 former student-athletes,” plaintiff attorney Kerry Sutton said, adding that the plaintiffs plan to appeal.

The athletes alleged Murphy committed abuse under the guise of treatment over multiple years, with conduct dating to at least 2013.

The Carolina Museum of the Marine opened June 8 in Jacksonville, drawing more than 1,000 visitors on its first day.

Located just steps away from Camp Lejeune at 109 Montford Landing Road off Lejeune Boulevard, the museum tells the story of Carolina Marines from World War II through the present.

The museum, which cost around $36 million to build, held its ribbon-cutting ceremony on Friday, featuring speeches by military leaders and dignitaries, including a keynote by Lt. Gen. Calvert Worth Jr.
