Article Icon 1Judge Throws Out DOJ Lawsuit

A federal judge on Tuesday dismissed a U.S. Department of Justice (DOJ) lawsuit accusing Colorado and Denver of interfering with federal immigration enforcement.

Filed last May, the lawsuit sought to overturn four Colorado and two Denver laws—known as "sanctuary" laws—limiting state and local cooperation with federal immigration officers. The DOJ argued such laws violate the Supremacy Clause.

In his dismissal, Judge Gordon P. Gallagher wrote that while states and cities can't contradict federal law, they're not required to use their resources to enforce it, concluding that "Colorado and Denver have the right to refuse to expend their resources to implement a federal regulatory program."

The DOJ has filed similar lawsuits against other states and cities, including Los Angeles, New York City, and Minnesota. A federal judge dismissed a case challenging Chicago's laws last year.

President Trump signed an executive order Tuesday laying out a plan directing new federal rules on states' use of mail-in ballots.

The order, "Ensuring Citizenship Verification and Integrity in Federal Elections," calls for states to use unique ballot envelope identifiers, such as bar codes, and directs DHS to compile a state-by-state list of eligible citizens to be shared with election officials. Noncompliant states could lose federal funds.

Colorado is one of eight states that allow all elections to be conducted primarily by mail, though it also offers in-person voting. Trump has cited Colorado's use of all-mail voting as "one of the big problems" he has with the state.

Several Colorado Democrats vowed to legally challenge the order, arguing it is unconstitutional and intrudes on states' authority to regulate elections.

An early spring storm arrived Tuesday evening, bringing rain to lower elevations and 6-12 inches of snow at peaks above 9,000 feet.

A colder storm develops tonight into tomorrow, shifting heavier snowfall to the north and central mountains. The far-south Wolf Creek Ski Area, however, is forecast to lead in volume, totaling 22-29 inches by Friday.

Highs will rebound to the 70s today before dipping into the 50s and 60s, respectively, on Friday and Saturday. Easter Sunday looks to be sunny and milder.

The April snow could boost Colorado's record-low snowpack, which has likely already peaked after rapidly melting in the March heat.
